Terms of Service

These Terms of Service ("Terms") govern your use of ShapeShifted ("the Game"), developed by Neanderthal Mountain Interactive, operated by Rocky J Solutions LLC ("we," "our," or "us"). By accessing or playing the Game, you agree to be bound by these Terms.

1. Agreement to Terms

If you do not agree to these Terms, do not use or access the Game.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial entertainment purposes.

3. User Conduct

You agree NOT to:

• Use the Game for illegal activities
• Cheat, hack, exploit, or modify the Game
• Use bots, automation, or unauthorized scripts
• Reverse engineer or attempt to access the Game's underlying code
• Interfere with other users' gameplay experience

4. Intellectual Property

All content in the Game—including graphics, gameplay elements, code, and branding—is owned by us and protected by U.S. and international copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5. User Data

Your scores, achievements, and settings are stored locally on your device. We may use aggregated, anonymized gameplay statistics to improve the Game.

6. Premium Features

• Payments are processed by Gumroad, a third-party payment provider
• All sales are final and non-refundable except where legally required
• Premium status is managed via license keys stored in your browser
• Premium features may be modified or discontinued at any time with reasonable notice
• Refund requests should be directed to info@rockyjsolutions.com within 14 days of purchase

7. Advertisements

The Game may display advertisements through Google AdSense. Premium users may have ads removed depending on purchased features.

8. Disclaimer of Warranties

The Game is provided "AS IS" without warranties of any kind. We do not guarantee that:

• The Game will function without interruption
• Defects or bugs will be corrected
• The Game is free of malware or harmful components
• Your progress will always be preserved

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, gameplay progress, or use of the Game.

10. Data Loss

Your progress is stored locally in your browser. We are not responsible for loss of data due to:

• Browser cache clearing
• Browser updates or changes
• Device loss, damage, or replacement
• Private/incognito browsing mode
• Operating system updates

11. Modifications to the Game

We reserve the right to update, modify, or discontinue the Game at any time. Significant changes may be communicated when appropriate, but we are under no obligation to provide advance notice.

12. Termination

We may suspend or terminate your access to the Game without notice or liability if you violate these Terms or for any other reason at our sole discretion.

13. Third-Party Services

The Game uses third-party services such as Google AdSense, Google Analytics, and Gumroad for payment processing. Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

14. Children's Use

The Game is intended for general audiences. If you are under 13, you must have parental permission to play. Parents are responsible for monitoring their child's use of the Game.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or use of the Game shall be resolved through binding arbitration in Kentucky, except where prohibited by law.

Exceptions:

• Either party may bring an action in small claims court if the claim qualifies
• Either party may seek injunctive relief in court to protect intellectual property rights

Class Action Waiver: You agree that disputes must be brought individually and not as part of a class action, collective action, or representative proceeding.

17. Changes to Terms

We may update these Terms at any time. We will update the "Last Updated" date at the top of the page. Continued use of the Game after changes constitutes acceptance of the updated Terms.

18. Severability

If any part of these Terms is found unenforceable or invalid, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the Game and supersede all prior agreements and understandings.
